A White woman who gave birth to a mixed-race baby after a sperm bank mistakenly gave her black sperm has lost her case.
The Midwest Sperm Bank in sent Jennifer Cramblett the sperm of a black African-American when she became pregnant four years ago.
She went on to give birth to Payton, now 3, who is a mixed-race child.
Cramblett, along with her partner Amanda Zinkon, sued the sperm bank saying their daughter would grow up an “outcast” in a predominantly white neighbourhood.
The Illinois sperm bank had already apologised and refunded part of the costs the gay couple had incurred.
Cramblett, from Ohio, argued the mistake had caused her family stress, pain, suffering and medical expenses.
The lawsuit stated: “Getting a young daughter’s hair cut is not particularly stressful for most mothers, but to Jennifer it is not a routine matter, because Payton has hair typical of an African American girl.
“To get a decent cut, Jennifer must travel to a black neighborhood, far from where she lives, where she is obviously different in appearance, and not overtly welcome.”
However, a judge threw out her claim for $50,000 (£33k) in damages saying her claim lacked any legal merit.
